A prenuptial agreement is a written document made before a marriage setting out the couple’s intentions regarding their finances and other arrangements during their marriage and what should happen when one of them dies or if the marriage breaks down.
Prenuptial agreements are not, in themselves, binding in legal terms. However, they are very strong evidence of the intention of the couple at the beginning of the relationship and will be considered by the court in making its decisions.
To minimise the chances of the prenuptial agreement being overturned it is important to make sure that each of you have independent legal advice on its content. The prenuptial agreement must be fair and carefully written with full disclosure of your individual and joint financial situations at the time that the the prenuptial agreement is made.
