A separation agreement is a written agreement for couples who no longer wish to live together.
Whilst commonly made by a married couple, any couple can draw up an agreement as a means of resolving and confirming the arrangements they have come to.
The separation agreement sets out how they wish to resolve the issues of money, property and children. To find out more please see our article: Separation agreements.
The court is not involved in the preparation of the document and can overturn, or disregard, it if it considers it unfair. It is therefore very important to have the document professionally written and to make sure you each take independent legal advice.
