As well as trusts set up in your will, a trust can be set up in your lifetime by a legal document that allows people (trustees) to look after the whole or part of your estate for the benefit of yourself and/or other beneficiaries selected by you. 

 

What are the benefits of a trust?

Trusts can:

  • assist in succession planning by insuring that assets pass from one generation to the next in accordance with the wishes of the previous generations without the fear that one individual will lose or waste assets left to them
  • limit exposure to inheritance tax and capital gains tax
  • be used to make provisions for others privately and to hold property for those who cannot hold it themselves, such as children.

The department also creates personal injury and disabled trusts for clients which, if done correctly, can mean the beneficiary of the trust can still receive benefits which are means tested.
